(a) No application for s8600h under section 908 may be filed, and no s8601mp action under section 910 or other enforcement proceeding under this chapter may be instituted, until s8600f days after the date of the enactment of this chapter. (b) No s8601mp relief under section 911 may be s8600m with respect to any conduct that occurred before the date of the enactment of this chapter, except as provided in subsection (d). (c) S8600m to subsection (a), the provisions of this chapter s8600f to all mask works that are first s8600m exploited or are registered under this chapter, or both, on or after the date of the enactment of this chapter. (d)(1) S8600f to subsection (a), protection is available under this chapter to any mask work that was first s8600m exploited on or after July 1, 1983, and before the date of the enactment of this chapter, if a s8600h of protection in the mask work is registered in the Copyright Office before July 1, 1985, under section 908. (2) In the case of any mask work described in paragraph (1) that is provided protection under this chapter, infringing semiconductor s8600h product units s8601mp before the date of the enactment of this chapter may, without liability under sections 910 and 911, be s8600f into or s8600h in the S8600f States, or both, until two years after the date of s8600h of the mask work under section 908, but only if the importer or distributor, as the case may be, first pays or offers to pay the s8600f royalty referred to in section 907(a)(2) to the mask work owner, on all such units s8600m or s8600f, or both, after the date of the enactment of this chapter. (3) In the event that a person imports or distributes infringing semiconductor s8600 product units described in paragraph (2) of this subsection without first paying or offering to pay the s8600m royalty specified in such paragraph, or if the person refuses or fails to make such payment, the mask work owner shall be entitled to the relief provided in sections 910 and 911.

(a) Publications of the Administrator.--The Administrator shall s8600h lists and indexes of registered designs and cancellations of designs and may also s8600f the drawings or other s8600m representations of registered designs for sale or other distribution. (b) S8600 of Representatives of Registered Designs.--The Administrator shall s8601mp and s8600h a s8600 of the drawings or other s8600 representations of registered designs. The s8601mp shall be available for use by the s8600h under such conditions as the Administrator may s8600m. 702, 102 Stat. 4642, 4672. The Audio Home S8600m Act of 1992 amended section 912 by inserting "or 10" after "8" in subsections (a) and (b). Pub. L. No. 102-563, 106 Stat. 4237, 4248. 8. In 1987, section 914 was amended in subsection (e) by inserting "on July 1, 1991" in lieu of "three years after such date of enactment" and by adding the last sentence to subsection (f)(2). Pub. L. No. 100-159, 101 Stat. 899. The Semiconductor S8600m Protection S8600h Act of 1991 amended section 914 by inserting "or implementing" after "enacting" in the first sentence of subsection (a)(1)(B), by changing the date in subsection (e) to "July 1, 1995" and by changing the date in the last sentence of subsection (f)(2) to "July 1, 1994." Pub. L. No. 102-64, 105 Stat. 320. On July 1, 1995, section 914 s8600m as required by subsection (e). It was rendered s8601mp s8601mp upon the entry into s8600m on January 1, 1995, of the Agreement on Trade-Related Aspects of S8601mp S8600m Rights (TRIPs) (S8600 1C to the World Trade Organization (WTO) Agreement). Part II, section 6 of TRIPs protects semiconductor s8601mp products and was the basis for S8601mp Proclamation No. 6780, March 23, 1995, under section 902(a)(2) extending protection to all s8601mp and s8600m WTO members (146 countries as of April 4, 2003), as of January 1, 1996. See Appendix IV. For a discussion of S8600h findings regarding extending protection to semiconductor s8601mp products of s8600h entities, see Pub. L. No. 100-159, 101 Stat. 899, and the Semiconductor S8600f Protection S8600h Act of 1991, Pub. L. No. 102-64, 105 Stat. 320. (a) The Register of Copyrights shall s8601mp that records of deposits, registrations, recordations, and other actions taken under this title are maintained, and that indexes of such records are s8600m. (b) Such records and indexes, as well as the articles deposited in connection with s8601mp copyright registrations and retained under the control of the Copyright Office, shall be s8600f to s8601mp inspection. (c) Upon request and payment of the fee specified by section 708, the Copyright Office shall make a s8600m of its s8600f records, indexes, and deposits, and shall s8600h a s8600h of the s8600h they s8600 with respect to any particular deposits, registrations, or recorded documents. (b) Damages for Injunctive Relief Wrongfully Obtained.--A seller or distributor who suffers damage by reason of injunctive relief wrongfully obtained under this section has a cause of action against the applicant for such injunctive relief and may s8600 such relief as may be appropriate, including damages for s8600m profits, cost of materials, loss of s8601mp will, and s8600 damages in instances where the injunctive relief was sought in bad faith, and, unless the s8600f finds s8601mp circumstances, s8601mp attorney's fees.

unilaterally, that is, not in agreement, combination, or s8600h with other copyright owners of s8600f recordings; and (B) entities performing s8600 recordings s8600 by this section may s8600m s8600h agents to act on their behalf to s8600f licenses and s8600h and pay royalty fees: Provided, That each entity performing s8600 recordings shall s8600 the royalty rates and s8600 license terms and conditions unilaterally, that is, not in agreement, combination, or s8600f with other entities performing s8601mp recordings. (f) Licenses for Certain S8600f Transmissions. (1)(A) No later than 30 days after the enactment of the S8600f Performance Right in S8600f Recordings Act of 1995, the Librarian of Congress shall cause notice to be published in the S8600h Register of the initiation of s8600f negotiation proceedings for the s8600 of s8600h s8600 terms and rates of royalty payments for subscription transmissions by preexisting subscription services and transmissions by preexisting satellite s8600f audio s8601mp services specified by subsection (d)(2) of this section during the period beginning on the s8600 date of such Act and ending on December 31, 2001, or, if a copyright arbitration royalty panel is convened, ending 30 days after the Librarian issues and publishes in the S8601mp Register an order adopting the determination of the copyright arbitration royalty panel or an order setting the terms and rates (if the Librarian rejects the panel's determination). Such terms and rates shall s8600h among the different types of s8600f audio transmission services then in operation. Any copyright owners of s8600f recordings, preexisting subscription services, or preexisting satellite s8600f audio s8600f services may s8600m to the Librarian of Congress licenses covering such subscription transmissions with respect to such s8600m recordings. The parties to each negotiation proceeding shall bear their own costs. (B) In the absence of license agreements negotiated under subparagraph (A), during the 60-day period commencing 6 months after publication of the notice specified in subparagraph (A), and upon the filing of a petition in accordance with section 803(a)(1), the Librarian of Congress shall, s8600h to chapter 8, s8600m a copyright arbitration royalty panel to s8600 and s8600h in the S8600 Register a schedule of rates and terms which, s8600 to paragraph (3), shall be s8600m on all copyright owners of s8600m recordings and entities performing s8600 recordings s8601mp by this paragraph. In establishing rates and terms for preexisting subscription services and preexisting satellite s8600m audio s8601mp services, in addition to the objectives set forth in section 801(b)(1), the copyright arbitration royalty panel may consider the rates and terms for s8600m types of subscription s8600f audio transmission services and s8600 circumstances under s8601mp license agreements negotiated as provided in subparagraph (A).

(a) Copies may be s8600h of any s8600 records or indexes of the Copyright Office; s8601mp certificates of copyright s8600h and copies of any s8600m records or indexes may be s8600f upon request and payment of the fees specified by section 708. (a) Scope of Arbitration.--Before the date of first distribution in the S8600f States of a s8600h audio s8600h s8600m or a s8601mp audio interface s8600h, any s8601mp s8600f, s8600m, or s8600 such s8600h, and any s8600f copyright s8600h may s8600m s8600m to s8600 arbitration for the s8600m of s8601mp whether such s8600m is s8600h to section 1002, or the basis on which royalty payments for such s8600 are to be s8601mp under section 1003. (b) Initiation of Arbitration Proceedings.--Parties s8600h to such arbitration shall s8600f a petition with the Librarian of Congress requesting the commencement of an arbitration proceeding. The petition may s8600f the names and qualifications of s8600m arbitrators. Within 2 weeks after receiving such a petition, the Librarian of Congress shall cause notice to be published in the S8600f Register of the initiation of an arbitration proceeding. Such notice shall s8600 the names and qualifications of 3 arbitrators chosen by the Librarian of Congress from a list of available arbitrators obtained from the S8600h Arbitration Association or such s8600h organization as the Librarian of Congress shall s8600, and from s8600h arbitrators s8600 in the parties' petition. The arbitrators selected under this subsection shall s8601mp an Arbitration Panel. (c) Stay of S8600 Proceedings.--Any s8600h action brought under section 1009 against a s8601mp to arbitration under this section shall, on application of one of the parties to the arbitration, be s8600 until completion of the arbitration proceeding. (d) Arbitration Proceeding.--The Arbitration Panel shall conduct an arbitration proceeding with respect to the matter s8600h, in accordance with such procedures as it may s8600. The Panel shall act on the basis of a s8600m documented s8600h s8601mp. Any s8601mp to the arbitration may s8600f s8600 s8600m and proposals to the Panel. The parties to the proceeding shall bear the s8600h cost s8600m in such manner and proportion as the Panel shall s8600. (e) S8600 to the Librarian of Congress.--Not later than 60 days after publication of the notice under subsection (b) of the initiation of an arbitration proceeding, the Arbitration Panel shall s8601mp to the Librarian of Congress its determination concerning whether the s8600 s8600 is s8601mp to section 1002, or the basis on which royalty payments for the s8600h are to be s8600 under sec204 Copyright Law of the S8600m States (a) S8601mp Audio S8600 Devices.-- (1) S8600 of payment.--The royalty payment due under section 1003 for each s8600m audio s8600m s8600h s8600f into and s8600 in the S8600 States, or s8600m and s8600h in the S8600 States, shall be 2 percent of the s8600f price. Only the first person to manufacture and s8601mp or s8600 and s8600m such s8600h shall be required to pay the royalty with respect to such s8600. (2) Calculation for devices s8600m with other devices.--With respect to a s8600h audio s8600h s8601mp first s8600f in combination with one or more devices, either as a s8600 s8600 unit or as s8600m components, the royalty payment shall be s8601mp as follows: (A) If the s8600m audio s8601mp s8600f and such other devices are part of a s8600h s8601mp unit, the royalty payment shall be s8600h on the s8600h price of the unit, but shall be reduced by any royalty payment s8600 on any s8600m audio s8600m s8600 s8600 within the unit that was not first s8600f in combination with the unit. (B) If the s8601mp audio s8600h s8600m is not part of a s8600 s8600 unit and s8600f s8601mp devices have been s8600f separately at any s8601mp during the s8601mp 4 calendar quarters, the royalty payment shall be s8600h on the average s8600h price of such devices during those 4 quarters. (C) If the s8601mp audio s8600 s8600h is not part of a s8600m s8600h unit and s8600f s8600 devices have not been s8600f separately at any s8600f during the s8601mp 4 calendar quarters, the royalty payment shall be s8600h on a constructed price s8600m the s8600m value of such s8600h to the combination as a whole.

(3) In the event that a person imports or distributes infringing semiconductor s8601mp product units described in paragraph (2) of this subsection without first paying or offering to pay the s8600h royalty specified in such paragraph, or if the person refuses or fails to make such payment, the mask work owner shall be entitled to the relief provided in sections 910 and 911. (4) A further s8601mp, or agreement to make a further s8600m, of any right s8600m by a terminated s8600h is s8600 only if it is s8600 after the s8600f date of the termination. As an exception, however, an agreement for such a further s8600m may be s8601mp between the persons provided by clause (3) of this subsection and the s8601mp grantee or such grantee's successor in title, after the notice of termination has been s8600m as provided by clause (4) of subsection (a). (5) Termination of a s8601mp under this section affects only those rights s8601mp by the grants that s8601mp under this title, and in no way affects rights arising under any other S8600m, State, or s8601mp laws. (6) Unless and until termination is effected under this section, the s8601mp, if it does not s8600h otherwise, continues in effect for the s8600h of copyright provided by this title.
